1. About these terms

These terms apply to midnightsoundsradio.com, run by Midnight Sounds. By using the website you accept them. If you don’t agree, please don’t use the website.

2. Using the website

You may listen to the music and browse the website for personal use. You may not damage the website, interfere with how it works, try to access parts that aren’t public, or use it for anything unlawful, fraudulent or harmful.

3. Music and other content

The tracks, artwork and names shown on the website belong to their artists and labels. Midnight Sounds premieres them with their permission. Playback comes from SoundCloud, YouTube and Spotify, under their own terms. You may not download, copy or redistribute this content except where the rights holder offers it, for example as a free download.

The Midnight Sounds name, logo and website design belong to Midnight Sounds.

4. Sending us your music

When you send a track or mix to promo@midnightsoundsradio.com, or through the Submit music form for any of our four services (Premiere, Free download, Repost or Radio show):

  • You confirm that you own the rights to it, or have permission from whoever does, and that it doesn’t infringe anyone else’s rights.
  • Sending a track doesn’t guarantee a premiere, free download, repost or radio show. We listen to every submission, but we choose what we publish.
  • If we select it, you allow Midnight Sounds to publish it on its channels (SoundCloud, YouTube and this website) to promote it. You keep all rights to your music.
  • We only accept WAV or AIFF files.

5. Paid services

Premiere, Free download, Repost and Radio show are paid services. The prices and what each one includes are the ones shown on the Submit music page when you send your submission.

  • Sending the form doesn’t make you pay anything. You only pay if we accept your track: we email you the PayPal payment link (payment is never made on the website). Once you’ve paid, reply with a screenshot of the payment; we check it and confirm the date.
  • Prices are in pounds sterling (GBP) and are paid through PayPal.
  • If, after you have paid, we can’t publish for a reason on our side, we will give you a new date or a full refund, whichever you prefer. Once your track has been published, there is no refund.
  • Premiere: you grant Midnight Sounds a limited, non-exclusive, perpetual, royalty-free, worldwide license to host, broadcast, stream and promote the track, use it in videos, and claim and monetize it on YouTube and SoundCloud, on its website, SoundCloud, YouTube and social media accounts. Midnight Sounds may also dispute third-party claims on the track on those platforms. Because the license is non-exclusive, you can keep licensing your track to others.
  • Premiere: you confirm that you own the master rights, or act on behalf of the company that owns them, that you’re legally able to grant this license, and that the track contains no third-party material that would prevent it. If someone makes a claim against Midnight Sounds because this isn’t true, you’ll cover the resulting costs, including reasonable legal fees.
  • Premiere: you whitelist the Midnight Sounds SoundCloud account (@midnight-sounds-radio) and YouTube channel (@midnight-sounds) with your distributor so the premiere isn’t blocked.
  • Free download: you authorize the free download of the track and confirm that you hold the rights to it.
  • The date you ask for depends on availability, and we confirm it by email.

6. Other websites

The website links to SoundCloud, YouTube, Spotify, Instagram and other services. We don’t control them and aren’t responsible for their content or how they handle your data.

7. Liability

We work to keep the website available and accurate, but we provide it as it is. As far as the law allows, Midnight Sounds isn’t liable for losses that come from using the website or from not being able to use it.

8. Changes

We may update these terms. The date at the top shows the latest version.

9. Applicable law

These terms are governed by the laws of Peru. Any dispute will be handled by the courts of Lima.
